1. Scope of Application

This Terms of Use/Cancelation Policy will apply to the user (“User”) of the services (“Services”) provided through the Nozawa Onsen Tourism Association Booking Website (this “Website”). When User books Hotels and guest houses listed under "Book Now", Terms of Use/Cancelation Policy set by the Hotels and guest houses booked apply preferentially.

2. Acceptance

By using the Services, User accepts this Terms of Use/Cancelation Policy.

3. Service

This Website provides the Services described below. The Services shall not include the travel business and travel agency business set forth in the Travel Agency Act (Act No. 239 of 1952).

3-a.Introduce accommodations at the Nozawa Onsen by providing information on this Website.

3-b. Recommend, when requested, accommodations meeting as closely as possible User’s preferences. Provide booking and/or payment service when User seeks to book recommended accommodations.

3-c. Hotels and guest houses assume responsibility for providing accommodation services. The contract will be made between User and the hotels and guest houses. The Nozawa Onsen Tourism Association, and Wasabiya Corp. and the Nozawa Onsen Ryokan Hotel Business Cooperative Group, which operate thisWebsite on behalf of the Nozawa Onsen Tourism Association, will not be involved in providing such services and assume no responsibility. Hotels, guest houses and the Nozawa Onsen Tourism Association may input User’s information to this Website on behalf of the User.

3-d. The due date for booking requests is discussed under “4.Booking Requests” below.

3-e. The due date for payment is discussed under “8. Deposit Amount and Due Date of Payment” and, “9. Due Date of Payment of Remaining Balance” below.

3-f. The cancelation policy and refund policy for bookings made through this Website are discussed under “10.Cancelation of Booking and Refund” and “11.Amendment of Booking and Refund” below. Should different cancelation policies exist for the hotel or guest house booked, this Terms of Use/Cancelation Policy will be applied to bookings completed through this Website.

4. Booking Requests

Users can request a booking by clicking “SUBMIT” on this Website. Booking requests submitted by phone, email or other means will not be considered booking requests submitted through this Website. Booking requests can be made until 9 days prior to the last day of the month which is two months prior to the first day of the stay.

5. Secured Booking

The booking is secured once the User pays the full amount of the deposit prior to the due date set forth in this Terms of Use/Cancellation Policy and the Nozawa Onsen Tourism Association sends confirmation of the receipt of the funds.

6. Finalized Booking

The booking will be finalized once the User pays the remaining balance prior to the due date, as set forth in this Terms of Use/Cancelation Policy, and the Nozawa Onsen Tourism Association sends confirmation of the receipt of the funds, if User is asked to pay the deposit and remaining balance separately. The booking will be finalized at the time of the initial payment, if User is asked to pay the full amount in order to secure the booking.

7. Nullified Booking Requests

Booking requests will be nullified if the booking is not secured by the due date. Booking requests cannot be reactivated once canceled.

8. Deposit Amount and Due Date of Payment

8-a. If the booking request is made 9 days or more prior to the last day of the month which is three months prior to the first day of the stay, the deposit amount shall be 20% of the full amount of accommodation fee plus consumption tax and must be paid by credit card within 2 days from the payment request.

8-b. If the booking request is made after 9 days prior to the last day of the month which is three months prior to the first day of the stay, the deposit amount shall be 100% of the full amount and must be paid by credit card within 2 days from the payment request.

9. Due Date of Payment of Remaining Balance

The due date for payment of the remaining balance (the amount calculated by deducting the deposit from the total accommodation fee) is one day prior to the last day of the month which is two months prior to the first day of the stay. User is deemed to agree to the payment of the remaining balance upon the payment of the deposit. Unless User cancels the booking prior to the due date for payment of the remaining balance, the credit card used by User to pay the deposit shall be automatically charged for the remaining balance.

10. Cancelation of Booking and Refund

A booking will be canceled if the booking is not finalized or the User requests that the Nozawa Onsen Tourism Association cancel the booking. The total amount paid by the User up to the time of cancelation will be charged as a cancelation fee. The cancelation fee will not be refunded under any circumstances.

11. Amendment of Booking and Refund

Bookings cannot be amended after payment of the deposit. If date, number of person or other terms of the booking need to be changed, bookings already made must be canceled and new booking must be made separately. No refund will be made for such cancelation. The new booking is not guaranteed and there is a risk you may not be able to book as intended.

12. System Problems

The Service uses emails to communicate with Users. There are risks related to the non-delivery of emails for various reasons including, but not limited to, system problems of the sender, receiver and other connecting systems. This Website intends to minimize these risks by re-sending emails as needed, however, it is impossible to reduce such risks by 100%. There is also a risk of a significant disaster causing system problems. The Nozawa Onsen Tourism Association, Wasabiya Corp. and the Nozawa Onsen Ryokan Hotel Business Cooperative Group assume no responsibility in such cases.

13. Privacy Policy

The privacy policy is set forth separately in the “Privacy policy”.

14. Governing Law

This Terms of Use/Cancelation Policy shall be governed by the laws of Japan, and the Tokyo District Court shall have exclusive primary jurisdiction with respect to all disputes arising with respect thereto. This Website may provide an English translation of all or part of this Terms of Use/Cancelation Policy, which is solely for convenience of the User, and the original will be the Terms of Use/Cancelation Policy written in Japanese, which shall prevail over any translation.

1.適用範囲

本規程は「野沢温泉インバウンド予約受付用ウェブサイト」（以下「本サイト」といいます）を通じて提供されるサービス（以下「本サービス」といいます）を利用するに当たり、サービス利用者（以下「利用者」といいます）が行う一切の行為に適用されるものとします。ただし、利用者が”Book Now”として掲載された宿泊施設等を予約した場合、予約した宿泊施設等が定める利用規程、キャンセルポリシーが優先的に適用されます。

2.本規程への同意

利用者は、本サービスを利用したことをもって本規程に同意したものとみなされます。

3.本サービスの内容

本サイトは、以下の内容の本サービスを提供します。なお、本サービスは、旅行業法(昭和 27 年法律 第 239 号)に定める旅行業及び旅行業者代理業を含まないものとします。

3-a.本サイト上での情報提供を通じ、利用者に野沢温泉村の宿泊施設等を紹介します。

3-b.利用者が希望する場合、可能な限りその希望の条件に近い宿泊施設等を紹介し、また、利用者 が当該宿泊施設等の予約の申込みを希望する場合、当該宿泊施設等の予約受付及び代金の請求を代 行します。

3-c.宿泊施設等は、それぞれ自己の責任において宿泊及び施設利用等に係るサービス（以下「施設提供サービス」といいます）を提供します。宿泊等に関する契約は利用者と宿泊施設との間で締結されます。一般社団法人野沢温泉観光協会（以下「野沢温泉観光協会」といいます）並びに野沢温泉観光協会が本サイトの運営を委託しているわさびや株式会社及び野沢温泉旅館ホテル事業共同組合（以下併せて「受託者」といいます）は、施設提供サービスに関し何らの関与もせず、責任も負いません。なお、宿泊施設等及び野沢温泉観光協会は、利用者に代わって本サイトに利用者の情報を入力することがあります。

3-d.利用者による施設提供サービスの予約(以下「予約」といいます)の申込みの期限は、別項< 4.予約の申込み>に定めます。

3-e.利用者による施設提供サービスに係る代金の支払時期は、別項<8.予約金の金額及び支払期限 >、<9.宿泊費残金の支払期限>に定めます。

3-f.本サイトを通じた予約に関する返金は、別項＜10.予約のキャンセル及びキャンセルに伴う返金＞及び＜11.予約の変更及び変更に伴う返金＞に定めます。なお、各宿泊施設等が独自の宿泊約款に返金についての定めを有する場合であっても、本サイトを通じた予約に関する返金については、本規程が当該宿泊約款に優先します。

4.予約の申込み

利用者は、本サイトの“SUBMIT”をクリックすることにより、予約の申込みをすることができます。電話又は電子メール等により、予約の意思を表明しただけでは、施設提供サービスの予約の申込みがあったことにはなりません。施設提供サービスの予約の申込みは宿泊初日の属する月の前々月末日の9日前まで可能です。

5.予約の成立

利用者が本規程に従って請求された予約金の全額を支払期限内に支払い、野沢温泉観光協会が資金受領の連絡を送信した時点で「予約の成立」となります。

6.予約の確定

利用者が予約の成立時点で支払総額（施設提供サービスの対価、付随する税金、手数料等を含む金額。以下同じ）を支払っていない場合、利用者は宿泊費残金（支払総額より予約金の金額を差引いた金額。以下同じ）の全額を支払期限内に支払い、野沢温泉観光協会が資金受領の連絡を送信した時点で「予約の確定」がなされ、施設提供サービスの提供が確約されます。利用者が予約の成立時点で予約金として支払総額を支払っている場合、「予約の成立」時点で「予約の確定」となります。

7.予約の不成立

所定の期限内に「予約の成立」がされない場合、「予約の不成立」となります。不成立となった予約を回復することはできません。

8.予約金の金額及び支払期限

8-a.宿泊初日の属する月の3ヶ月前の月末日の9日前又はそれ以前に予約の申込みが行われた場合、宿泊費総額に消費税額を加えた額の20%に相当する金額を予約金とし、その支払期限は請求日から2日間、支払手段はクレジットカードによる支払いとします。

8-b.宿泊初日の属する月の3ヶ月前の月末日の9日前より後に予約の申込みが行われた場合、支払総額を予約金とし、その支払期限は請求日から2日間、支払手段はクレジットカードによる支払いとします。

9.宿泊費残金の支払期限

宿泊費残金の支払期限は、宿泊初日の属する月の前々月末日の前日とします。利用者は、予約金の支払いにより宿泊費残金の支払いに同意したものとみなし、宿泊費残金の支払期限までに当該予約をキャンセルしない場合、予約金の支払い時に使用したクレジットカードにより、自動的に宿泊費残金を支払うものとします。

10.予約のキャンセル及びキャンセルに伴う返金

予約が成立した後に利用者より野沢温泉観光協会に対しキャンセルの申出があった場合「予約のキャンセル」となります。一旦キャンセルされた予約を回復することはできません。予約をキャンセルする場合、理由のいかんに関わらずキャンセルの時点までに支払われた金額に相当する金額がキャンセル料となります。したがって、予約のキャンセルによる返金はいたしません。

11.予約の変更及び変更に伴う返金

予約金支払い後の予約内容の変更はできません。宿泊日程、人数等の変更が必要な場合は、予約をキャンセルし、新規に予約を申込むことになります。この場合、予約キャンセルによる返金はいたしません。新規に予約を申込む場合、当初の希望通りの内容で予約できることは保証されません。

12.システム障害

本サービスは、利用者との連絡に電子メールを利用します。電子メールは発信者、受信者及びそれを仲介する各種システムの不具合又は一時的なサービス停止等により送信、受信が正確に行われないことがあります。本サイトでは未着となった電子メールを再送信する等の対策を講じております。しかしながら、利用者側の問題を含む様々な要因により電子メールによる連絡が正確に行われない可能性を完全にゼロにすることはできません。また、大規模な災害等の理由により電子メールを含む本サービスの提供に必要なシステムが障害を起こす可能性もあります。これらのシステム障害に起因する損害等について野沢温泉観光協会及び受託者は一切の責任を負いません。

13.個人情報保護

利用者の個人情報の保護及び取扱いは、個人情報保護方針によるものとします。

14.準拠法、言語

本規程の準拠法は日本法とします。本規程、本サイト又は本サービスに関する一切の紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。また、本サイトは本規程の一部又は全部の英語訳を表示することがありますが、当該英語訳はあくまで利用者の便宜のために提供されるものであり、原本は日本語の規程とします。
